Mr. Meyer recently won a summary judgment in favor of a lawyer in a legal malpractice case that arose from a divorce proceeding. The divorce case had a long and sordid history: judgment was entered in 2001 but post-decree proceedings continued through the end of 2007. By that time, the plaintiff had already sued our client, one of her divorce attorneys who had represented her in both pre- and post-decree proceedings. During her deposition, she admitted to suspecting, more than three years before she filed the lawsuit against him, that this lawyer had made mistakes during the pre-decree proceedings. We moved for summary judgment on the ground that the complaint was filed outside of the two-year statute of limitations application to claims against lawyers in the provision of professional services. After extensive briefing, the trial court agreed and entered summary judgment in favor of our client.
